SERVICE PERSONNEL SPECIAL LEAVE

The regulations governing work exemptions for employees and civil servants include special leave for personal events, illness of relatives or children, civic duties, and other special occasions, including the respective requirements and scope of the leave.

Medical Treatment

Employees are granted time off work for medical treatment if this must take place during working hours.

Personal matters, including routine doctor's appointments, must be dealt with outside working hours. In such cases, a change or interruption of working hours may also be considered. The employee must, if necessary, demonstrate the necessity of medical treatment during working hours. Medical treatment also includes medical examinations and medically prescribed treatment.

The management of the respective university institution is responsible for approving time off work for the above reasons.

Voluntary Work

Special leave may be granted in accordance with the law on strengthening voluntary work in youth work.

To perform voluntary work in the local council, district council, or the corresponding representative body of another public corporation, institution, or foundation subject to state supervision, in the district advisory board or local council, or as a court-appointed guardian.

The HR Division is responsible for approving time off work.

Maximum of ten working days (paid) special leave
Illness of a Relative

Serious illness of a relative, provided that they live in the same household. (Relatives are blood relatives or relatives by marriage, but not partners).

Leave will only be granted if no other person is immediately available to provide care or support and the doctor certifies that the presence of the employee or civil servant is necessary.

The HR Division is responsible for approving leave of absence.

Illness of a Caregiver

Serious illness of a caregiver, as a result of which the employee must take over the care of their child who is under the age of 8 or who is in need of constant care due to a physical, mental, or emotional disability.

Leave is only granted if no other person is immediately available to provide care or support and the doctor certifies that the presence of the employee or civil servant is necessary.

If a serious illness is foreseeable, e.g., a planned operation, the employee is not entitled to paid time off unless they demonstrate that their attempt to find another caregiver has been unsuccessful.

Illness of a Child

Regulations for employees in the event of illness of children under the age of 12 who are covered by family insurance under the statutory health insurance scheme:

Serious illness of a child under the age of 12 if there is or has been no entitlement under Section 45 of the German Social Code, Book V (SGB V) in the current calendar year. In cases under Section 45 SGB V, only unpaid leave is granted, as there are claims against the health insurance fund.

Leave is only granted if no other person is immediately available to provide care or supervision and the doctor certifies the necessity of the employee's or civil servant's presence.

The HR Division is responsible for approving leave of absence.

Up to four working days per calendar year
Illness of a Child

Regulation for civil servants in the event of illness of privately insured children under the age of 12:

Necessary supervision, care, or nursing of a 

  • sick child who has not yet reached the age of 12 or
  • is disabled and dependent on assistance

The HR Division is responsible for approving leave of absence.

Up to ten working days per calendar year for each child. A maximum of 25 working days in total per calendar year.

For single parents, a maximum of 20 working days per calendar year for each child. No more than 50 working days in total per calendar year.

Remuneration will be maintained for 9/10 of the approved days.

Anniversary

25 and 40 years of service.

The time off work must be taken in close proximity to the anniversary, but not necessarily on the day itself.

Birth of a Child to the Spouse or Partner
Bei Niederkunft der Ehefrau (nicht der Lebensgefährtin) bzw. der Lebenspartnerin i. S. d. Lebenspartnerschaftsgesetzes.

Civic Duties

When fulfilling general civic duties under German law, the employee is entitled to continued payment of remuneration

  • if the time off is required by law and
  • if the duties cannot be performed outside working hours, even after they have been rescheduled.

If a claim for compensation for remuneration can be asserted, there is no entitlement to continued remuneration.

Conferences, Training Courses, Events

Time off may be granted for participation in conferences, training courses, and events, provided that they

  • serve civic purposes or
  • are organized by organizations whose activities are in the public interest and there is public interest in the conferences, training courses, and events, or

serve professional purposes and are in the interests of the employer.

Scope of special leave for employees:

Up to three working days per calendar year.

If three days' leave is not sufficient, up to ten days' leave with continued pay may be granted in individual cases above the standard rate. However, extremely strict criteria must be applied.

Up to five working days per calendar year.

In individual cases, up to ten days of leave with continued pay may be granted. However, extremely strict criteria must be applied.

Death of a Relative

In the event of the death of

  • the spouse (not a partner)
  • the life partner within the meaning of the Civil Partnership Act
  • a child (biological children, adopted children, foster children, and stepchildren, but not grandchildren)
  • of a parent (biological or adoptive parents, but not foster parents, step-parents, grandparents, or parents-in-law)

time off must be taken in close proximity to the event, but not necessarily on the day of the event.

Moving

When moving to another location for work or business reasons.

Time off must be taken in close proximity to the event, but not necessarily on the day of the event.

Other Reasons

In addition, continued remuneration may be granted for the following specific reasons

  • Activities on examination and vocational-training committees and in social security institutions
  • Trade union purposes
  • Performance of other important tasks.

Unpaid short-term leave:

In justified cases, short-term unpaid leave may be granted if compatible with the official or operational circumstances.

Working Time Reduction Day
The working time reduction day for civil servants, also known as the “AZV day,” is one day per year on which civil servants in Germany receive an additional day off (Section 5 AzUVO).
